Terms of Sale

1) Seller identity

These terms and conditions (the “Terms of Sale”) govern purchases made on lorenzopapace.fr by consumers within the meaning of EU and Irish law.

2) Scope and acceptance

Placing an order on the site constitutes full acceptance of these Terms of Sale. The version applicable is the one in force on the date of payment. The Seller may amend the Terms of Sale at any time for future orders.

3) Products, prices and taxes

The essential characteristics of each artwork and the tax-inclusive price are shown on the product page.

  • EU: prices include VAT where applicable.
  • Non-EU: prices are shown exclusive of taxes; import taxes/duties may apply on arrival (Incoterms DAP).
  • Photos are illustrative. Availability subject to stock.

4) Order & contract formation

Journey: select product → enter details → accept the Terms of Sale → review/confirm → payment → confirmation email.
The Seller may refuse an order that is abnormal or made in bad faith.

5) Payment

Payment at checkout via secure providers: WooPayments (card), PayPal.
No cheque payments. Card transactions are encrypted and become irrevocable once validated.

6) Delivery

(summary — see Shipping Policy)

  • Preparation: 1–2 business days.
  • Dispatch from Ireland via UPS (Standard/Express).
  • Fees: EU: free shipping from €200; Non-EU: free from €320 (otherwise a flat fee shown at checkout).
  • Non-EU — DAP: import taxes and duties are payable by the recipient.

7) Transfer of risk & retention of title

Risk passes to the Customer on delivery. Title in the artworks remains with the Seller until full payment.

8) Right of withdrawal (distance sales – EU)

You have a 14-day right of withdrawal from receipt, without giving any reason, in accordance with EU law as applied in Ireland (you must notify your decision within this period; you then have a further 14 days to return the artwork).

Exceptions: custom-made/personalised works, unless defective.
The Seller may withhold the refund until the artwork is received or evidence of shipment is provided, and may apply a deduction for any handling beyond what is necessary to inspect the item (diminished value).

9) Returns & refunds (process)

  • Request via the form (or email).
  • Return the artwork in its original packaging (or equivalent protective packaging), with tracking and, where appropriate, insurance.
  • Return costs are borne by the Customer (or a prepaid label may be deducted from the refund).
  • Refund to the original payment method within 14 days of withdrawal notice, subject to receipt of the artwork or proof of shipment.

10) Legal conformity and remedies

Artworks must conform to the contract. In case of a lack of conformity, you are entitled to the remedies provided under Irish consumer law (repair/replacement, price reduction, termination as applicable). These rights are in addition to any commercial guarantee and are exercised against the Seller.

For cross-border assistance, you may contact the European Consumer Centre in your country of residence.

Governing law & jurisdiction: these Terms of Sale are governed by Irish law; the Irish courts have jurisdiction, without prejudice to your mandatory consumer rights within the EU.

12) Intellectual property

The sale of an artwork does not transfer any copyright. The author retains all moral rights (attribution, integrity, etc.) and economic rights (representation, reproduction, adaptation, resale right). Any unauthorised reproduction or use is prohibited.

13) Personal data

Data processing is carried out in accordance with the GDPR and the Data Protection Act 2018 (Ireland). See the Privacy Policy for purposes, legal bases, retention, recipients, your rights (access, rectification, erasure, objection, portability) and the Irish supervisory authority’s contact details.

14) Force majeure

No liability where performance is prevented by an unforeseeable and irresistible event (strikes, damage, network outages, administrative decisions, etc.).

15) Severability – Changes

If any clause is invalid, the remainder of the Terms of Sale remains in force. Any contractual change requires written agreement. Updates published on the site apply to future orders.
